Terms of Service

These terms govern your use of Websy (the “Service”), at websy.ai. By creating an account or using the Service, you agree to these terms. If you don’t agree, please don’t use the Service.
1. What Websy is
Websy is a tool that uses AI to help you build, edit, and host websites. You describe what you want, and we generate it. You can publish your website to a free Websy subdomain or attach your own custom domain.
2. Your account
You need an account to use Websy. You’re responsible for keeping your login secure and for everything that happens under your account. You must be at least 13 years old to use Websy. If you’re using Websy for a business, you confirm you have the authority to bind that business to these terms.
3. Subscription plans and billing
Websy offers a free plan and paid plans (Starter and Pro), billed monthly or annually through Stripe. You can also buy one-time AI credit boosts. Paid plans auto-renew at the end of each billing period until you cancel.
- Cancel anytime. Cancel from your account page; you keep access through the end of the period you’ve paid for.
- All sales are final. Subscription fees, AI credit boost purchases, and domain & email charges are non-refundable, except where required by law or where we charged you for something we were unable to provision (in which case we refund that charge).
- Price changes. We’ll give you at least 30 days’ notice before raising the price of your plan. New prices apply at your next renewal.
- AI credits. Monthly AI credit quotas reset each billing cycle and don’t roll over. Credit boosts you buy never expire while your account is active.
4. Your content
Anything you create or upload using Websy — text, images, code, your website itself — is your content. You own it. We claim no copyright, trademark, or other ownership in it.
You grant Websy a limited license to host, store, display, and process your content for the sole purpose of providing the Service to you (so we can generate, save, and serve your website). That license ends when you delete your content or close your account.
5. What you can’t do
You agree not to use Websy to:
- Publish websites that violate any law, infringe on others’ intellectual property, or contain hate speech, harassment, sexual content involving minors, or threats of violence.
- Scrape, reverse-engineer, or attempt to extract our AI models, prompts, or system instructions.
- Send spam, phishing, malware, or anything that overloads or interferes with the Service.
- Resell or repackage the Service as your own (white-label use requires a separate agreement — email support@websy.ai).
- Use Websy on behalf of someone else without their permission, or impersonate any person or business.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
6. AI-generated content
Websy uses third-party AI models (currently Anthropic’s Claude for text/layout and Google Gemini for images) to generate content based on your prompts. You acknowledge:
- AI output can be inaccurate, biased, or unexpected. Review what you publish before sharing it with the public.
- You’re responsible for ensuring your prompts and the resulting content don’t infringe on anyone else’s rights.
- Websy doesn’t warrant that AI-generated content is unique; two users could generate similar output from similar prompts.
7. Custom domains
Starter and Pro plans can attach custom domains you own. You’re responsible for the domain registration and its renewal. We provide free HTTPS via our hosting provider but don’t guarantee specific uptime for domain-related services.
8. Form messages on your published websites
When visitors submit forms on websites you publish with Websy, we collect and store those messages on your behalf so you can read them in your inbox and receive notification emails. You are the data controller for that data; Websy is your data processor. You’re responsible for disclosing your data practices to your own visitors (e.g. via your website’s own privacy policy).
9. Service availability
We aim for high uptime but don’t promise the Service will be available without interruption. We may perform scheduled maintenance, and outages caused by upstream providers (Vercel, Supabase, Stripe, Anthropic, Google, Resend) are beyond our direct control.
10. Termination
You can close your account anytime from your account page. We may suspend or terminate your account for violations of these terms. When your account ends:
- Published websites are taken down within 7 days.
- Your data — websites, the messages you receive, analytics — is retained for 30 days for recovery, then permanently deleted.
- You can request immediate deletion at support@websy.ai.
- Unused monthly AI credits and unused credit boosts are non-refundable.
11. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the maximum extent allowed by law, Websy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will meet your expectations.
12. Limitation of liability
To the maximum extent allowed by law, Websy’s total liability to you for any claim arising out of the Service is limited to the amount you paid Websy in the 12 months before the claim, or $100, whichever is greater. We are not liable for any indirect, consequential, incidental, or punitive damages, including lost profits or lost data, even if we’ve been advised of the possibility.
13. Indemnification
You agree to defend and hold Websy harmless from claims by third parties that arise out of your content, your use of the Service in violation of these terms, or your violation of any law.
14. Changes to these terms
We may update these terms occasionally. When we make material changes, we’ll notify you by email or via an in-app banner at least 14 days before they take effect. Continuing to use Websy after that means you accept the updated terms.
15. Governing law
These terms are governed by the laws of the United States. Disputes will be resolved in the courts of competent jurisdiction where Websy is operated. Nothing here waives any rights that can’t be waived under your local consumer protection laws.
